This is a FREEWARE SOURCE-AVAILABLE license. The Software is distributed free of charge for the uses permitted here and its source code may be publicly inspectable, but this License is NOT an Open Source or Free Software license in the OSI/FSF sense because it restricts commercial use and public redistribution of modified versions.
1.1 "Licensor" means Officina Turini, the rights holder of the original QPE code, documentation, and other original materials, unless otherwise stated.
1.2 "Software" means Quantum Phenomena Explorer, including executables, source code, project files, scripts, shaders, resources, documentation, Help, examples, configuration data, and materials distributed in the QPE package, excluding Third-Party Components.
1.3 "Source Code" means source and project files made available by the Licensor for studying or rebuilding QPE.
1.4 "Documentation" means the Help, Markdown files, Doxygen documentation, technical notes, diagrams, and other original explanatory material distributed with QPE.
1.5 "Non-Commercial Use" means personal, hobby, educational, training, academic, museum, public-outreach, non-commercial research, or evaluation use that does not directly produce revenue, fees, royalties, commercial advantage, or paid deliverables substantially based on the Software.
1.6 "Commercial Use" includes, without limitation: selling or sublicensing the Software; including it in a paid product or service; using it as a substantial component of billed consulting, analysis, or services; distributing it for payment; using it in systems intended for sale; offering it as a service; or directly using it to generate a commercial product or service for clients. Ordinary educational use by schools, universities, associations, museums, fablabs, and research institutions is not considered Commercial Use merely because those organizations employ staff, charge tuition/membership fees, or receive funding, provided QPE itself is not sold separately or used as a specifically billed commercial component.
1.7 "Modified Version" means any copy of the Software or Source Code that is altered, adapted, extended, translated, functionally changed, or combined to create a derivative work different from the Licensor's official distribution.
1.8 "Third-Party Components" means libraries, runtimes, tools, fonts, drivers, APIs, or other materials not owned by Officina Turini and governed by their own licenses.
Subject to this License, the Licensor grants you a worldwide, non-exclusive, royalty-free license, personal or organizational as applicable, to:
(a) install and run copies of the Software for Non-Commercial Use;
(b) make backup or archival copies;
(c) use QPE for study, teaching, demonstrations, conferences, exhibitions, educational laboratories, amateur activities, and non-commercial research;
(d) inspect and study the Source Code made available;
(e) compile the Source Code for your own Non-Commercial Use;
(f) modify the Source Code for study, experimentation, and internal Non-Commercial Use, subject to the public-redistribution restriction for Modified Versions in Section 5.
No ownership of the Software is transferred.
3.1 QPE may be used free of charge by schools, universities, public research bodies, non-profit associations, museums, fablabs, study groups, scientific events, and outreach initiatives within Non-Commercial Use.
3.2 Screenshots, plots, and results produced by the Software may be shown in lessons, presentations, papers, theses, posters, videos, and educational material. Where reasonably practical, attribution as "Quantum Phenomena Explorer - Officina Turini" is appreciated. Such attribution does not turn a QPE result into experimental evidence or a quantitatively validated prediction of the real world.
3.3 QPE is a scientific Explorer Tutor and does not replace primary literature, independent calculations, experimental data, certified instruments, or peer review.
You may redistribute complete and unmodified copies of the official QPE package free of charge, including executables and/or source, provided that:
(a) the package is supplied free of charge;
(b) copyright notices, Licensor name, license files, notices, Help, and attributions are not removed or altered;
(c) you do not state or imply that you are the author, rights holder, or exclusive official distributor of QPE;
(d) you do not impose additional terms that reduce the rights granted by this License;
(e) all licenses of any Third-Party Components you redistribute are separately respected.
Documented reimbursement of actual physical-media or shipping costs is permitted, but no license fee, subscription, or commercial margin may be charged for the Software.
5.1 Source Code is made available for transparency, study, verification, learning, compilation, and experimentation subject to this License.
5.2 You may create Modified Versions for your own internal Non-Commercial Use.
5.3 Public redistribution, online publication, delivery to third parties, or making available a Modified Version, in source or binary form, requires prior written permission from Officina Turini. This does not prohibit publishing patches, diffs, or short excerpts solely for technical discussion, review, or contribution proposals, provided clear attribution is retained.
5.4 No Modified Version may use the name, logo, or identifying elements of "Quantum Phenomena Explorer" or "Officina Turini" in a way that suggests it is an official or approved release, unless written permission is granted.
5.5 Access to Source Code grants no rights in trademarks, trade names, logos, or the Licensor's visual identity.
6.1 Any Commercial Use of the Software, Source Code, or a Modified Version requires a separate commercial license or prior written authorization from Officina Turini.
6.2 Without such authorization you may not, among other things:
(a) sell, rent, sublicense, or monetize QPE;
(b) incorporate QPE or substantial portions of its code into a commercial product;
(c) distribute QPE as a component of hardware or software sold for payment;
(d) offer access to QPE as a paid or cloud service;
(e) use QPE as a substantial component of a technical service specifically sold to a customer;
(f) remove this License and replace it with proprietary redistribution terms.
6.3 Commercial, OEM, integration, modified-redistribution, or other special rights require prior written consent from the Licensor.
7.1 All rights not expressly granted remain reserved to Officina Turini or the respective third-party rights holders.
7.2 Redistributed copies must preserve copyright and license notices.
7.3 "Quantum Phenomena Explorer", "QPE", "Officina Turini", and associated logos may identify the origin of the Software but may not be used to imply unauthorized sponsorship, endorsement, or affiliation.
8.1 This License applies only to original QPE material for which Officina Turini holds the applicable rights. It does not modify, replace, or expand licenses of Third-Party Components.
8.2 QPE is developed with Qt and may depend, depending on the build and distribution, on Qt, compiler runtimes, graphics drivers, and other system components. Those components remain subject to their respective licenses.
8.3 Anyone redistributing a QPE build is responsible for identifying and complying with the terms applicable to components actually included in that distribution, including any requirements concerning notices, license texts, linking, relinking, library source availability, or other obligations imposed by the license selected for those components.
8.4 THIRD_PARTY_NOTICES.txt provides practical information but does not replace original third-party license texts.
9.1 QPE is designed as an educational, exploratory, and visualization tool for physical and numerical models. It is not a certified measuring instrument, medical device, safety system, control system, certification tool, or universal simulation with guaranteed accuracy.
9.2 Many QPE experiments use ideal models, dimensionless units, approximations, boundary conditions, simplified potentials, effective models, or representative real-world scales. The "Model & Constraints" pages and numerical documentation are integral to scientifically correct interpretation of the Software.
9.3 No QPE result should be treated, without independent verification, as experimental measurement, certified quantitative prediction, technical prescription, or guarantee of a real system's behavior.
This License does not require the Licensor to provide support, maintenance, corrections, updates, new versions, future compatibility, or permanent availability of downloads or source code. Any support is voluntary unless separately agreed in writing.
This License is not a technical statement about networking, telemetry, or data processing in a particular build. Users are responsible for checking the actual characteristics of the version they use and for protecting their own files, data, and working environments.
Rights granted by this License terminate automatically upon material breach. After termination you must cease unauthorized use and redistribution. Rights may be reinstated through written permission from the Licensor or through cure of the breach where the Licensor expressly accepts such cure.
If any provision is held invalid or unenforceable, the remaining provisions remain effective to the maximum extent permitted. Failure by the Licensor to enforce a right does not permanently waive that right.
Subject to mandatory law applicable to an individual user, this License is governed by the laws of the Italian Republic. Competent jurisdiction shall be determined by applicable law and any separate written agreement between the parties.
The Italian version of QPE-1.0 is the reference text. The English translation is provided for international convenience and is intended to carry the same meaning; in case of interpretive conflict, the Italian version prevails unless mandatory law requires otherwise.
This License is the standard agreement for the uses of the Software described above. Commercial, OEM, partnership, modified-redistribution, or other rights may be granted separately in writing by Officina Turini and, where granted, control the specifically authorized scope.
